A. Right of Withdrawal

Introduction

Consumers have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the transport service provider, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Moto Termico, Weselerstr 312, 47169 Duisburg, Germany, E-mail: support@mototermico.de) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but its use is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the period.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

This applies in particular to heat protection and paint protection products from Moto Termico, provided that these are individually manufactured for the vehicle model selected by the customer or the respective configuration only after the order.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which your notification of withdrawal was received by us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will you be charged any fees for this repayment. We are entitled to refuse repayment until we have received the goods back or until you have provided proof that you have sent the goods back – whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than within fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking the condition, properties and functionality of the goods.

General Notes

1) Please avoid damage or contamination of the goods. Please return the goods to us in their original packaging with all accessories and all packaging components if possible. If necessary, use suitable protective outer packaging. If you no longer have the original packaging, please ensure sufficient protection against transport damage with suitable packaging.
2) Please do not send the goods back to us freight collect.
3) Please note that the above notes under item 1–2 do not constitute a prerequisite for the effective exercise of the right of withdrawal.
